General terms and conditions of sale
ARTICLE 1 - GENERAL AND LEGAL INFORMATIONS
Tetraghorn is a boutique of handcrafted decorative objects run by Ivanie Roulet since 2023. Each object is imagined and handmade by Ivanie Roulet. Only one person makes the products on the website.
The present conditions are concluded between Ivanie Roulet, registered with the Banque Carrefour des Entreprises under number 0687.462.061, whose registered office is located at 5650 Fontenelle, Rue du Grand Clerc, 2, BELGIUM, through the Tetraghorn boutique, and the persons making a purchase on the www.tetraghorn.com website, hereinafter referred to as “the Customer, the Consumer or the User”. The contact address for all communications is info@tetraghorn.com.
These general terms and conditions define the terms and conditions of sale between Tetraghorn and the Customer, and apply to any User who uses its website.
The parties expressly agree that their relationship shall be governed exclusively by the present terms and conditions, and in the absence of any other condition, shall be governed by Belgian law.
The Customer declares that he/she has full legal capacity to enter into the present terms and conditions.
ARTICLE 2 – THE ORDER
Any User of the site or the Customer must provide all the information required to confirm the order. Depending on the product catalog available online, the Customer will transmit the items he/she wishes to purchase by validating an online order form. By validating an online order, the Customer enters into a sales contract with Tetraghorn and expressly acknowledges having read and agreed to the present terms and conditions. The Customer will receive an e-mail confirming his/her order.
All orders will be honoured within the limits of available stocks of products, failing which, Tetraghorn will inform the Customer of the availability times.
The Customer may also request personalized or customized creations (cards, illustrations, notebooks, decorations, printable products, etc.). Any specific request must be made using the contact form available on the site.
A personalized quotation is then sent by e-mail, detailing the content of the order, any options, the price and the estimated delivery time. The customer may then confirm the quote or request adjustments.
Validation of the quote constitutes a firm commitment. An invoice is then issued, payable in full in advance. Production begins only after payment has been received.
Creation and dispatch times are given as an indication only. Due to their personalized nature, these orders are excluded from the right of withdrawal, except in the case of defect or non-conformity.
ARTICLE 3 – THE PRICE
The prices of the items sold are those in force on the day the order is taken. They are denominated in euros and calculated with the applicable VAT. Consequently, they will be increased by the shipping costs applicable on the day the order is placed. Delivery charges vary according to the weight and size of the order and the delivery destination. Tetraghorn refers to the prices communicated by the delivery intermediaries Bpost and Mondial Relay and does not propose a fixed price for delivery charges.
The prices indicated do not include any taxes or customs duties in the event of delivery outside Belgium.
Tetraghorn reserves the right to modify its prices at any time, and to add any new taxes or rate increases. Items will be invoiced on the basis of the prices in force at the time orders are registered.
Full payment must be received at the time of order in order for the goods ordered to be delivered or delivered to the workshop.
Article 4 – DELIVERY METHODS
Tetraghorn offers the most appropriate means of delivery. Items ordered on the website are mainly shipped within Belgium or the EURO zone, at the Customer's express request.
If stock is available, delivery times will vary between 3 and 10 days from confirmation and payment of the order by the Customer. In the event of unavailability of the product ordered, the Customer will be informed as soon as possible. They may then choose to wait for the product to be restocked or cancel the order. In the event of cancellation, a refund will be made within 30 days of confirmation.
In the case of custom orders, a lead time of 14 to 31 working days is required for the production and dispatch of the order from the time of contact between Ivanie Roulet and the Customer. In the event of an order requiring a longer lead time, Tetraghorn undertakes to communicate this lead time via the means of contact communicated by the Customer. If the customer does not validate the new lead time, it will be considered accepted.
Orders are deposited with the shipper no later than Fridays, or the last working day of the week in the case of public holidays.
The customer is obliged to check the conformity of the articles on receipt. If no written complaint is received within 48 hours, the order will be deemed to have been accepted.
The customer is obliged to check the conformity of the articles on receipt. If no written complaint is received within 48 hours, the order will be deemed to have been accepted.
Tetraghorn may not be held liable in the event of force majeure, i.e. any act or circumstance whatsoever which is irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be avoided by them. The Customer may choose between several delivery companies offered by Tetraghorn.
Consequently, any reasonable delay in the delivery of the products shall not give rise to the payment of damages or the cancellation of the order.
Transport risk is borne entirely by the Customer.
The Customer is solely responsible for providing a correct postal address and information concerning him/her. Tetraghorn is not responsible for incorrect delivery. The Customer will be liable for additional shipping costs if the order has to be returned to the correct address, and the shipment will be rerouted only after payment of the additional costs. These additional costs will only be known once Tetraghorn has taken the necessary steps to return the goods to the distributor.
The “collection from workshop” option is available as a delivery method when the customer completes the order (only for Belgian billing addresses). As there is no delivery, no delivery costs are charged. The Customer undertakes to collect his order from the workshop by his own means. Once the order has been confirmed, the Customer will be invited to make an appointment on the website. The necessary information (workshop address, date and time) will then be clearly known to both parties and mutually agreed. If the customer is unable to attend, Tetraghorn will contact the customer to arrange a new appointment by mutual agreement. In the event of prior cancellation, a refund will be made. If the Customer is unable to attend, he/she undertakes to inform Tetraghorn at least 24 hours before the appointment. Another time slot may then be agreed between the two parties. In the event of an unannounced absence during a collection at the workshop, Tetraghorn reserves the right to cancel the order without refund and to put the items back on sale.
In the event of unavailability of its website or telephony network, Tetraghorn will take all necessary measures to remedy the problems, without the Customer being able to claim termination of the contract and/or damages.
ARTICLE 5 - PAYMENT
Payment for purchases is made at the time the order is placed. Tetraghorn does not charge a deposit. The full price is due at the time of the order. Online payment is made via the payment intermediary MOLLIE. The following payment methods are available: AMERICAN EXPRESS, DISCOVER, MASTERCARD, VISA, PAYPAL, BANCONTACT and BELFIUS.
The Customer guarantees that he/she has all the necessary authorizations to use the method of payment and Tetraghorn reserves the right to suspend any order and/or delivery in the event of refusal of payment by bank or credit card by banking organizations.
Tetraghorn also reserves the right to refuse to make a delivery and/or to honour an order from a Customer with whom a payment dispute is in progress.
ARTICLE 6 - RIGHT OF WITHDRAWAL
The customer has the right to withdraw from the purchase within 14 calendar days of receipt/delivery of the order. This right of withdrawal will not apply if you have ordered goods made to measure or to customer specifications, or if modifications/alterations to the original condition have been made. This right does not apply to products made to measure or personalized according to customer specifications, in accordance with article VI.53, 3° of the Belgian Code of Economic Law.
Tetraghorn will not accept the Customer's cancellation if the original item has not remained intact in its original packaging with all its accessories. Returned goods will not be accepted if they have been damaged, altered or used in any way. Goods that are incomplete, damaged or soiled by the Customer will not be taken back.
The Customer must inform Tetraghorn in writing of his/her intention to cancel the purchase, either by e-mail (info@tetraghorn.com) or by registered post. The Customer must return the item(s) in their original condition and packaging, together with any accessories. Return shipping costs are at the Customer's expense.info@tetraghorn.com
In accordance with article VI.53, 3° of the Belgian Code of Economic Law, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalized.
Thus, all products made to measure or personalized at the customer's request (dimensions, colors, prints, specific materials, etc.) are excluded from the right of withdrawal. No cancellation, refund or exchange will be accepted once the order has been confirmed and manufacturing has begun, except in the case of lack of conformity, in accordance with applicable legal provisions.
The customer expressly acknowledges, by validating his order, that he loses his right of withdrawal for this type of product.
ARTICLE 7 - COPYRIGHT AND USE OF CREATIONS
All creations offered, whether standard or made-to-measure, are original works protected by copyright, in accordance with Book XI of the Belgian Code of Economic Law and current international conventions.
The customer benefits from a personal and private right of use of the delivered works, for non-commercial purposes only. Any reproduction, modification, distribution, public representation, resale, or commercial use - in whole or in part - is strictly forbidden without the prior written consent of Ivanie Roulet.
In the case of personalized orders, Tetraghorn undertakes not to reproduce or imitate protected works, in particular those belonging to companies, artists or registered trademarks (e.g. film characters, licensed fictional universes, etc.). Tetraghorn reserves the right to refuse any order that contravenes copyright legislation.
Any request for inspiration from an existing artistic universe (graphic style, atmosphere, tonality) will be considered in accordance with the law and the originality of the creation.
By ordering a custom-made work, the Customer accepts that the artist's own style may be freely expressed in the production, with no obligation to achieve a mimetic result.
ARTICLE 8 - CONFIDENTIALITY
All information, whether commercial or of any other nature whatsoever, that either party may have gathered on the other party, in any form whatsoever, including orally, is confidential. Each party undertakes, on the one hand, not to disclose or communicate to any person all or part of such confidential information and, on the other hand, to take all steps to ensure that such confidentiality is preserved.
Each party, as beneficiary, undertakes not to use the confidential information for any purpose other than the performance of the contract. The parties undertake not to claim any industrial, literary or artistic property rights on the confidential information or on the knowledge established on the basis of this confidential information. Documents of any kind supplied by the parties remain the property of the party who supplied them.
ARTICLE 9 - COMPETENT COURT
These terms and conditions are governed exclusively by Belgian law. In the event of a dispute, only the courts of the judicial district of Namur, Dinant division, shall have jurisdiction.
