ARTICLE 1 - GENERAL AND LEGAL INFORMATIONS

Tetraghorn is a boutique of decorative and eco-responsible handcrafted objects owned by Ivanie Roulet since 2023. Each object is imagined and handmade by Ivanie Roulet. Only one person makes the products on the website.

The present terms and conditions are concluded between Ivanie Roulet, through the Tetraghorn store, registered with the Banque Carrefour des Entreprises under number 0687.462.061, whose registered office is located at 5650 Fontenelle, Rue du Grand Clerc, 2, BELGIUM, and the persons making a purchase on the website www.tetraghorn.com, hereinafter referred to as "the Customer, the Consumer or the User".

The present general conditions define the terms of sale between Tetraghorn and the Customer and they apply to any User who uses its website.

The parties expressly agree that their relationship shall be governed exclusively by these general terms and conditions and in the absence of any condition, they shall be governed by Belgian law.

The Customer declares that he has full legal capacity to enter into the present general conditions.

 

ARTICLE 2 - THE ORDER

Any User of the site or the Customer will have to communicate all the necessary data for the confirmation of the order. According to the product catalog put online, the Customer will transmit the items he/she/they wishes to purchase by validating an online order form. By validating the online order, the Customer concludes a sales contract with Tetraghorn and expressly acknowledges having read and agreed with the present general conditions. The Customer will receive an e-mail confirming his/her/their order.

All orders will be honored within the limits of available stocks of products and if not, Tetraghorn will inform the Customer of the availability delays.

 

ARTICLE 3 – THE PRICE

The prices of the articles sold are those in force on the day of the order. They are denominated in euros and calculated without taxes. Consequently, they will be increased by the rate of VAT and transport costs applicable on the day of the order. Delivery costs vary according to the weight and size of the order and the delivery destination. Tetraghorn refers to the prices communicated by the delivery intermediaries Bpost and Mondial Relay and does not propose a fixed price for the delivery costs.

Tetraghorn reserves the right to modify its prices at any time, to increase any new tax as well as the increase of the rates. The articles will be invoiced on the basis of the prices in force at the time of the recording of the orders.

The delivery or the handing-over in workshop of the ordered purchases require the complete payment at the time of the order or at the time of its withdrawal.

 

Article 4 – DELIVERY METHODS

Tetraghorn offers the most appropriate means of delivery. The shipment of items ordered on the website is done mainly in Belgium or in the EURO zone on express request of the Customer.

In case of available stock, delivery times will vary between 3 and 10 days from the confirmation and payment of the order by the Customer. In case of unavailability of a product, Tetraghorn will confirm the possible availability of a product and the delivery time which may vary between 14 and 31 working days from the confirmation of the order to the Customer. This period is the time necessary to produce a handmade product in optimal conditions in case of stock shortage. In case of confirmed unavailability, the Customer will have the possibility to cancel the order and Tetraghorn will then reimburse the customer within 30 days from the confirmation of unavailability.

In the case of custom orders, Tetraghorn requires a period of 14 to 31 working days for the realization and shipment of the order from the time of contact between Ivanie Roulet and the Customer. In case of an order requiring a longer delay, Tetraghorn commits to communicate this delay via the means of contact communicated by the Customer. In case of absence of validation of the new deadline from the customer, it will be considered as accepted.

The deposit of orders at the shipper is done on Fridays or last working day of the week in case of holidays.

The Customer is required to check the conformity of the order and in case of receipt, the order will be considered as accepted. In case of refusal of the delivery, you must inform Tetraghorn by e-mail : info@tetraghorn.com or via the contact form, and this within 48 hours after the delivery. 

In case of late delivery or loss of the package, you must contact Tetraghorn as soon as possible by e-mail : info@tetraghorn.com or via the contact form.

Tetraghorn may exclude the questioning of its responsibility in case of force majeure, that is to say, any fact or circumstance whatsoever that is irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be avoided by the latter. The Customer has the choice between several delivery companies proposed by Tetraghorn.

Consequently, any reasonable delay in the delivery of the products will not give rise to the allocation of damages or the cancellation of the order.

The risk of transport is borne entirely by the Customer.

The Customer is solely responsible for providing a correct postal address and information about him. Therefore, Tetraghorn is not responsible for an incorrect delivery. The Customer will have to pay additional shipping costs if the order has to be returned to the correct address and the shipment will be redirected only after payment of the additional costs. These additional costs will be known only when Tetraghorn has made the return arrangements with the distributing company. 

In case of an order on the website and a collection in the workshop, it will be possible to pay only in cash when the article(s) is (are) collected if the order is not yet paid. The "pick-up in workshop" option is available as a delivery method when you finalize your order. As there is no delivery, no delivery costs are charged. The Customer undertakes to pick up his order at the workshop by his own means. As soon as the order is confirmed, Tetraghorn will contact the Customer in order to fix the time and date of the pick-up. The necessary information (address of the workshop, date and time) will then be clearly known by both parties and accepted by mutual agreement. In the event of prior cancellation, a refund of the amount will be made. In case of impediment, the Customer agrees to inform Tetraghorn before the appointment. Another time slot can then be agreed between the two parties. If the Customer does not show up without informing Tetraghorn beforehand or does not show up within 7 calendar days, Tetraghorn reserves the right to put the item back on sale without refund.

In case of unavailability of its website or its telephone network, Tetraghorn will take all necessary measures to remedy the problems, without the Customer being able to claim the termination of the contract and/or the granting of damages.

 

ARTICLE 5 – PAYMENT

The payment of purchases is made at the time of the order. Tetraghorn does not apply a deposit for the order of custom-made items, the total price is due at the time of the order. A possibility is however offered to the Customer to pay in cash only when picking up the goods in the workshop. The online payment is made either by bank transfer or through Paypal payment offering : VISA, MASTERCARD, AMERICAN EXPRESS, DINERS CLUB INTERNATIONAL, DISCOVER, JCB, MAESTRO, MASTERCARD, UNIONPAY and BANCONTACT.

The Customer guarantees that he/she has all the necessary authorizations to use the method of payment and Tetraghorn reserves the right to suspend any order and/or delivery in case of refusal of payment by credit or bank card from the banking institutions.

Tetraghorn also reserves the right to refuse to make a delivery and/or to honour an order from a Customer with whom a payment dispute is pending.

 

ARTICLE 6 – RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from his purchase within 14 calendar days from the receipt/delivery of his order. This right of withdrawal will not apply if you have ordered goods made to measure or according to the customer's specifications or if modifications/alterations to the original condition have been made.

Tetraghorn will not accept the Customer's cancellation if the original item has not remained intact in its original packaging with all accessories. Returned goods will not be accepted if they are damaged, altered or used in any way. Goods that are incomplete, damaged or soiled by the Customer will not be taken back.

The Customer must inform Tetraghorn in writing of his intention to cancel his purchase and this notification must be made by registered mail or by e-mail (info@tetraghorn.com). In case of return of the parcel and after having informed of the cancellation within the above-mentioned period, the Customer will take care to protect the product(s) to be returned with the utmost care and the cost of returning the parcel will always be at his expense.

 

ARTICLE 7 – CONFIDENTIALITY

All information, commercial or of any nature whatsoever, that one of the parties may have gathered on the other party, in any form whatsoever, including orally, is confidential. Each party undertakes, on the one hand, not to disclose or communicate to anyone all or part of this confidential information and, on the other hand, to take all measures to ensure that this confidentiality is preserved.

Each party, as beneficiary, undertakes not to use the confidential information for any purpose other than the performance of the contract. The parties undertake not to claim any industrial, literary or artistic property rights on the confidential information and on the knowledge established from this confidential information. Documents of any kind provided by the parties shall remain the property of each party that provided them.


ARTICLE 8 - COMPETENT COURT

The present general conditions are exclusively governed by Belgian law. In case of dispute, only the Courts of the judicial district of Namur, Dinant division, will be competent.
